Rudy H 10-26-2006, 03:40 PM Is it legal for an employer to offer an employee compensation to drop his unemployment Insurance claim?? ScottB 10-26-2006, 04:14 PM I have never heard that before. Given the way unemployment works, it would probaly cost the company more to pay some compensation than to eat the costs of the unemployment. rjc 10-26-2006, 04:40 PM It is not ... or rather let me state that that kind of agreement is a violation of public policy. In other words, you could agree to it, but still file a claim and continue to file your weekly claims and the employer could not argue that there is a legally enforceable agreement whereby you agreed to forego your unemployment benefits. Rudy H 10-27-2006, 08:20 AM Scott, I think the company would be trying to prevent thier ins. premium to increase. This is where the cost savings would apply. Rjc, Does this apply to Calif. Law?? rjc 10-27-2006, 09:17 AM Rjc, Does this apply to Calif. Law?? Does what apply? Rudy H 10-27-2006, 09:30 AM Rjc, I was reffering to your posting regarding the violation of public policy. cbg 10-27-2006, 09:50 AM Rudy, you asked this on the CA board, right? So why do you think rjc would give you an answer that would not apply in CA? Rudy H 10-27-2006, 10:39 AM Excellent Point CBG. Rjc Location is Massachussetts so I was trying to make sure it applied to CA. Thank you for your clarification. cbg 10-27-2006, 11:33 AM Most of the regular responders here have multi-state experience. Weird state.:o |
