We found out that our boss has offered a new employee covered garage parking while the rest of us park outside. Is this legal to offer this to one employee and not everyone else? The parking is $65 a month and is paid by our company.
Yes, that is legal. Despite a widespread and mistaken belief to the contrary, no law says that all benefits, without exception, have to be offered to all employees if they are offered to any. Parking is not a protected benefit; as long as the employer is not choosing who does and who does not get this benefit on the basis of race, religion or other protected characteristic, he can offer it to anyone he wants.
