View Full Version : Forced to Quit, not sure what my rights are? California

Not sure if I have a case here but I am curious. I was employed at company for the last 7 months. Within the last 2 months they hired a woman who was completely abusive, rude and demeaning to me personally. I have email to prove this. I complained to my boss who in return told me to "quit complaining and be patient". Approximately 4weeks later I again complained to my boss and tried to nip the situation in the butt by responding to an email she sent me questioning if there was something underlying here and what could I do to correct this situation and make us work better. My boss was cc'd on this email...his reply was to "never cc' him again he was not a refree". Comments were then made to co-workers of mine like "becareful who you trust" and "I never wanted to say this before but, she always talked bad about you" Meaning me all these comments were made about me from my supervisor. I walked out and sighted Hostile work enviroment, and slanderous statements. I have yet to be paid from them. I have over 3 weeks pay due me and have received nothing. I have all the demeaning emails that have ever been sent to me in hard copy. Do I have a case?

Commenting on your comapny's failure to provide you with 3+ weeks of wages after you quit work... California law mandates that an employer must pay an employee his/her full wages within 72 hours of termination if the employee quits work. If an employer willfully fails to do so, the employee is entitled to what is referred to in the law as "waiting time" penalties -- one full days wages (up to 30 days) for each day the employer did not tender payment. The state of California can help you secure payment from your ex-employer, if you file a wage claim with the DLSE http://www.dir.ca.gov/dlse/Form1.pdf

As to any claims you may have against your employer for harrassment, discrimination, retaliation, etc... this depends on the detail facts and circumstances surrounding your situation. It's difficult to advise from your posting, and I suggest you review your issues with a local attorney.

In a word, "No."

You have not shown that the person who was "demeaning" you did so based upon some protected class.
