I work full time for or a water delivery company in Southern California. I get paid minimum wage plus commission. Last week HR told us that in January 1, 2007 when the minimum wage is raised to $7.50 we would stay at $6.75. Is this possible?

I am going to assume that you are now making minimum wage plus you get a "commission" for delivering bottled water to customers. (In reality, this is not a commission, but a piece rate).

If the above is true, then what looks like is going to happen is that you will be paid $7.00 per hour (new minimum wage) OR $6.75 per hour plus commissions, whichever is more. The bottom line is that the company cannot pay you less than the new minimum wage, but you will get more if your base pay plus commissions exceeds $7.00 per hour.

The new minimum wage in Ca for 2007 will be $7.50, going up to $8.00 in 2008. http://www.leginfo.ca.gov/pub/bill/asm/ab_1801-1850/ab_1835_bill_20060912_chaptered.html
