i was just wondering if an employer can hold your paycheck if you do not turn in your work shirts right away. i told them that i would bring them in when i find them.

How long an employer can hold your final paycheck in NH depends on whether or not you quit, were laid off, or were fired, and, if you quit, how much notice you gave.

Under no circumstances can they make it longer than the next regular payday after your last day of work. There are several permutations in between.

May I suggest that you make finding the shirts a priority? There is other action they can take if you do not return their property and you wouldn't enjoy it.

well we just got a new manager and i walked out on her, but everyone ive talked to said that it was illegal to hold a paycheck for uniforms, i also had a problem with the DM not getting me my raise from 2 months ago that i haven't seen yet either.

Since you quit without notice, they have until the next regular payday to release your final check. "Everyone" is wrong UNLESS your employer goes past the next regular payday after your last day of work. Then it is illegal, but not because of uniforms; because they can't hold your check for ANY reason longer than that.

Barring a binding and enforceable contract that says otherwise, they have no legal obligation to provide you with a pay raise at all, much less make it retroactive or pay it out at termination.

i just found out that she cant hold my paycheck and printed out a copy of the labor law that states that just in case she decides to try it

yeah i know its just that payday is today and i called to see if they checks were there and she told all that so i have been trying to find something to shut her up

While they can't hold your paycheck they can take you to small claims court for the cost of the unreturned uniforms. So instead of looking for something to "shut her up" you need to spend some time looking for the shirts.
