Hi
I delivered on Sept 11,2006 and the doctor has certified 8 weeks of PDL. I want to take the FMLA for 6 weeks following the PDL. I have calculated that I have to join back on DEcember 20,2006. Is that correct?

PDL=8weeks=8*5=40 working days ie Nov 6 2006
FMLA=6 weeks=6*5=30 working Days ie Dec 19 2006 taking into consideration columbus day and Thanksgiving holidays.

For one, FMLA and PDL would run concurrent. You don't get 8 weeks PDL, then 6 weeks FMLA. You get 12 weeks FMLA, which overlap with 8 weeks PDL. You also don't "count out" holidays. If a holiday falls during a period of leave it just gets treated like any other day.

If you had the baby on 9/11, your 12 weeks would be up 12/4.

If you qualify for CFRA, then you would be eligible for 12 weeks after PDL. This would put you on leave until 1/27.

If you only want to take 6 weeks of CFRA leave (the Cal. equivalent of FMLA leave) you are free to do so. That is when your Paid Family Leave payments will run out. You have to have worked for the company for 1250 hours and one year, and the company must have 50 employees within 75 miles.

It is calendar weeks, not work weeks, so you would go back December 18, 2006.
