My husband works for the City as a Police Officer. Her has over 500 hours of sick time and 100 of vacation time. He was planning on taking leave after our baby is born in November and using his sick hours.....he was told by the Human Resource Department that "california law" only allows him to use 40 hours of his sick time, and yet they also indicate that he has exhaust his sick time before he goes on "unpaid status." Help! This is so confusing. I have looked everywhere for the "law" that states he can only use 40 hours. Do you know what they're talking about?

It is probably a municipal regulation not the "law". I'd have him ask where the policy can be found. There may very well be a limit on how much sick time may be used for public employees for non-medical reasons or for family members medical conditions.

But he should probably resign himself to using up his vacation time, if that is what they want him to do.

Thanks for the response.....the reason he wants to use his sick leave also, is that he is going to be staying home caring for our child for more hours/days that the amount of vacation time he has.

And are they saying that after he uses his vacation and 40 hours of sick time, they won't grant him unpaid leave? He should probably clarify what they want they want from him. If they are saying he can only take 140 hours, he should talk to his union about it.

What leaves does a father qualify under CA? Do they just qualify for FMLA? Need to make sure that when we designate leaves, we cover all.
