I work in an resturant environment. Business is not always constant, although we try to manage the schedule on sales forcast, often time there is a problem with over scheduling. In order to control labor cost, we ask for volunteers to clock out and go home, if there are no volunteers, we as management send home people on a first in, first out basis. Are there any laws that are being violated by this?

It doesn't look like New Mexico has any stringent labor laws, so not a problem there, nor would you be breaking any Federal laws.
