View Full Version : New Jersey-Job stressing me out, making me sick

I am high risk because of my age. I am 23 weeks. My job doesn't have light duty for pregnante people. I work in a warehouse, where I do heavy lifting, load trucks, and drive equiptment which shakes me all over the place. The baby is going to hate roller coasters when I'm done with him. LOL I have been missing alot of time because of being sick, exhausted or body hurts. I know of 5 woman who have had misscarriages and 1 woman whos baby was born still, within the several years I have been with this company. I am very concerned about this, and I feel this is where alot of my stress if comming from that makes me sick. I brougt this concern up to my employers and they told me "We don't have light duty here. We don't accept restrictions."

Now for my question, because of the stress that I feel my job is causeing me would I be able to collect disability or do I have to just suffer and pray that nothing happens to my baby?

My job told me to apply for FMLA so I can maybe save my job, because of all the time I missed. My employer has a point system, where you are only allowed to get 8 points in a year. If the FMLA goes threw I keep my job, if it don't I will get fired. Can they do this?

You can take FMLA for any serious health condition and it provides 12 weeks of job protection per year. If you are off because of morning sickness and your doctor certifies that you need to be off for this, then yes, you may use FMLA. If you are off for other reasons not certified by your doctor, or do not invoke FMLA, then yes, you can be treated as anyone else and have the points accumulate.

In order to go out on FMLA, you doctor would have to certify that you are medically unable to do your job because of your pregnancy. While I can understand your reluctance to want to do this kind of job while pregnant, unless your doctor says there is a medical reason you need to be out, it doesn't fall under FMLA. Fear that something might happen does not fall under FMLA.
