I have a niece that rented a house about two months ago and the attic is infested with bats. In the closet where the opening to the attic is at there is fecal matter about an inch high. Well about two weeks after my niece moved into this house her little girl that is a year and a half started getting sick and has been sick every since. She has been to the doctor four times and they said that she has Histoplasmosis. This is a fungal infection caused by bird or bat droppings that has accumulated over a long period of time.
It gets down in your lungs and can also affect the heart. Anyway she is very sick and the doctors have told them to get out of the house this was on the
10/5/06 and the doctor reported the problem to the Health Department.

She contacted the Landlord and she told my niece that she would not give her deposit back nor would she give back October's rent of $650.00 which was paid on 10/1/06 in full. The landlord said she is not responsible for the bats and the clean up. And after that she would not answer anymore of her calls concerning this problem.

She signed a 6 months lease but can she break the lease and get her money back. The doctors did say that she needed to stay out of the house because her little girl was so sick from this. And since the landlord stated that she was not responsible for the bats or the clean up can she get her money back. She has got to find another place to stay.
