This will be a bit long. But, I can not seem to find a lawyer in my town that will give me a straight answer. I think a they have a touch of the "good ole boy" attitude.

We listed our property about 6 months ago. Someone from Florida wanted to purchase it. We agreed on a price and he put down the ernest money. We went back and forth about the closing and when he could take control. My listing agreement was 30 days from the closing date. Finally, we gave in that we close and he would take control of the proerty 3 days later. My real estate agent assured me this was a done deal and a cash sale and that i wouldn't get the amout of money we settle for and I better take it and run. So, trusting in his 25 years of experience we found a rental house and moved. Two days before closing my agent called and said the guys deal fell through, something about zoning problems. I told him that if he were to put down more money I would hold the property for 30 days. That should give him enough time to settle things.

Two days later I get a call telling me the guy didn't want to put anymore money down. He said the only way he would buy it now if we were to drop the price $30K. I said no.

I found out later that this guy didn't have any property under a sale contract. Therefore, he lied when he signed that our sale was pending the sale of his property and it would be a 10-31 exchange.

Now i am told i have to pay to have the ernest money to go infront of the judge. I have been out so much more that the little bit of money that was put down. It was only 1000.

The guy offered me $300 for my troubles and said the only way he would buy if we sell it to him for $200,000.

I feel this guy knew what he was doing. We go through the expense to move etc and we would come down on the price. HE WAS WRONG!

I also feel we were misreprenented by the listing agent and feel in some way the agent knew what was going on.

This is a rough version of the events that unfolded. I hope there is someone out there in cyber space that can help me.

Contact the state realtor's board and tell them your tale of woe. They will be able to help you with the agent.

As for the buyer, sue him.
