I have FMLA and am allowed to use 1-2 days at a time for my illness. Is there ANY way a company can get around the FMLA regulations and fire me for using it? A supervisor told a lead (and the lead is a really good friend of mine) that "I better watch out cuz I'm gonna be fired." I know that is considered hearsay, but now I am scared to use my FMLA and am having to go in to work when sometimes I shouldn't be for fear of being fired. What to do? Thanks......

You cannot be fired for taking FMLA. However you can be fired for job-related performance issues. FMLA does not excuse subpar performance. If performance is an issue, it may be worthwhile to discuss your concerns with your supervisor or HR. At least you'd know where you stand with respect to performance expectations.

Oh I know that when it comes to performance I am in the top and have been told that several times by my superior so I am not worried about that. But when it comes to another supervisor saying things about me getting fired because I use my FMLA, do I just ignore it for now to not stir things up anymore or do I bring it to someone's attention now and get it documented?

Also FMLA is not open ended. You are entitled to up to 12 weeks of unpaid time off or the equivalent in individual days used. Once you have used that time up it IS legal to term you for any subsequent days missed.
