I was just wondering if it was legal for employers to assign times that paychecks have to be picked up in? My husband recently quit his job and went in to get his last paycheck and they said he has to pick it up between 2 & 4 (which is impossible since we are working during that time). They never had this rule when he was working there so I was just wondering what we should do?
Thanks,
Lacy Moore

Just what do they plan to do if an employee cannot make it in to the office during that very short window?

They should not hold the check, unless the employee directs that it be held, so, they should mail it or do whatever else the employee directs.

It would be wrong for them to open the window for picking up checks only once a week and, should you miss the window, force you to wait a week for the next opportunity.

Dumb question. If the employees who are working during that window are at the job site, why can't the supervisor just get the checks and give them out to the employees when they complete their work day?

Sometimes there is not a supervisor that can do that. We have temps that work all over the place and there is no way that the client supervisor will pick up and deliver the paycheck for one or two temps.

We deliver to job sites and we have checks in the office for pickup. Any checks not picked up by the close of business are mailed, unless the employee has told us not to mail it (happens frequently!).

Your employer can not hold your check, at least not from state laws I've seen but they can certainly specify when you can pick it up. Just imagine had an employee requested odd hours, what type of burden that would place on the employer. Certainly not the case here but it does leave open that possibility. I would try to work with them, at the very least have them mail it, worse case it gets to you in a day or so.

Or, even better, sign up for direct deposit if the employer offers it. (It's the "payroll" in me. :o )
