My sister had sexual intercourse at 15 with a 19 year old and now she is pregnant. Now she may be wanting to give the baby up for adoption, but he will not agree at this time. Does he have any rights to the baby?

He does not have any rights AT THIS TIME (the baby is not born yet), but he can register with the putative father registry to prevent her from giving the baby in adoption before he has a chance to establish legal paternity and sue for his paternal rights. Has anybody reported him to the police for having sex with a child? The doctor is required to report that a child is pregnant. I don't know if the Doctor has reported anything, I will try to find out. He can establish paternity by just filing in court to establish paternity, whether he registers or not. The putative registry is just to ensure that the mother cannot legally give the child in adoption before legal paternity is established. In order to give the child in adoption if he does not want her to, she will have to say that she does not know who the father is. Obviously, that is false, and as such, fraud. Now, if he fails to establish legal paternity and she admits that he is the bio father, a notice will be sent to him. If he does not respond or waives the right to object, the adoption can be completed without his consent. Otherwise, he will need to consent. However, he is kind of over a barrel here, as he committed a crime and the baby is just proof of his crime. BigBro 10-05-2006, 09:30 AM ok, thank you very much!!!!! :D |
