View Full Version : Racial and hostile workplace Florida

I live in Central Florida and work for a company named XXXX XXX Inc.. They are in Texas. I work full time and I do property inspections for them in Florida. There have been many racial slurs made by the Florida regional manager and threats of termination if more production is not met. I am Caucasian and have immediate family that are African Americans and the manager knew this and yet continued to make these comments. The company has their employees wear name badges with our photo on them, when I received my badge my pictured had been altered to look different. I confronted the manager about this and he claimed he didn’t know how that happened. In Aug of 2006 the company came down from Texas to Florida to have a meeting with all the field inspectors. I sat with another inspector that was trained with me by the same manager he showed me his badge that was taken on the same day and his was also altered to make him look like a Jewish person. I asked him if he said anything to the manager and he said the manager told him he did it as a joke.

There have also been threatening remarks towards me when the regional manager told me that I hade to travel out of town to do inspections. When I stated to him that I could not afford to pay for 3 nights of hotels and wait to get paid back 5 weeks later. He got really angry and loud and in a very threatening tone that he didn’t give a (used swear word). When I told him that the verbal agreement that the vice president-field operations promised me along with the written agreement that the Human resources gave me stated that my route would be Orange and Osceola counties only nothing about over night travel. He then proceeded with more threatening hostile actions and said that he didn’t care that I was a very muscular man and that he could easily do his best to take me out. This manager has mentioned that he was a retired officer from Louisiana so I took his threat very seriously, due to the fact that he has knowledge and probably access to weapons.

I have also contacted the human resources for the company and made a claim, I kept my identity unknown in fear that there would be some form of threatening retaliation and possibly termination of my employment. Human resources stated they needed me to come forward however they could not guarantee my employment would be safe along with my safety. I do feel that there could be some sort of retaliation whether it is threatening with harm or employment termination.

I was injured on the job on July 3, 2006 and my medical bills still have not been paid. I did file a workers comp claim after I had repeatedly made attempts to have my employer and their insurance pay the medical bills. These are just a few of the issues that have occurred. There have been other instances of abusive treatment in the workplace. I have made good notes of dates and times and saved all emails. I also have copies of my employment application package.

How does one alter a photo to make someone "look" Jewish? How was yours altered?

As for the language issue, no law requires that your employer be civil or act like a decent human being. You don't mention the context that the inappropriate language is being used it but it doesn't appear to be directed to you. Have you told him when he is calm that you do not appreciate his language and the racial slurs and want it to stop?

Along with that follows that it isn't illegal for your supervisor to yell at you. He can threaten to fire you if production is not being met. He can insist you go on the out of town assignment unless you have a contract in place that states you will not be asked to travel. A letter outlining your usual territory is not a contract that forbids them from sending you on such a trip. He can make you front the money for the trip. None of it is illegal. It may be incredibly poor mangement, but no law prevents it. Have you checked with HR or AP about getting reimbursed or advanced money for the trip?

Unfortunately annonymous complaints are very difficult to follow up on. In fact, in cases where it doesn't sound like any laws are being broken and it is more of a case of an employee not getting along with their manager, annonymous complaints often are not pursued. If you are truly afraid of this guy, why do you still work there? I would be dusting off the resume and seeking employment just about anywhere else.

As for your WC claim, your employer wouldn't pay that directly. It would need to be filed with their WC carrier. You would have 30 days to file the claim. If you haven't filed the claim, the carrier is not going to pay the bills.

I'm not sure what other absue you refer to. Can you be more specific? Not everything that happens at work that could be considered "abuse" is legally actionable.
