it was heavy raining and i was driving on a 35 speed limit road.my speed was 30 or less. the light was green then suddenly a guy on a wheel chair just cross the street so i hit my break right away but it was too slippery so i hit him.he was'nt hurt but the wheel chair is broken. the policeman asked the guy if he saw the light was green or red, he said he did not see he was just assuming it was his right of way. the policeman gave me ticket, and he told me i should plead not guilty and he would testify for me. he said it wasn't my fault it was a bad weather. what do you guys think of my situation. please give me ideas and advice please.

Is this just traffic court or were you charged with something else? Did this guy file a civil claim against you for damages?

no...i wasn't charged with anything else, i have to appear in court because this happened in illinois and i have a michigan driver's lisence, it wil expire next year and that's when i am planning to renew it...

I might be wrong, but I think if you moved to this state, you can not wait for the other liscense to expire, you must apply for the states liscense that you are in, after a certain amount of time living there, not sure how long. Did you have insurance? It is true that a pedestrian has the right of way, but if they are not abiding by the laws, then it makes it to where it is not entirely your fault. For example, I was hit by a car, but I was jaywalking, so it was found that the insurance would pay my medical, but a lawyer told my mom, that it would be hard to get anything else, because I was jaywalking. Is the guy suing you, and what was the ticket for?

i got a ticket because of my driver's license, and i hit a pedestrian, and yes i have an insurance. my insurance interviwed me and the guy i hit on the telephone ad he said it's not my fault at all. and also the policeman is on my side.

I know I sound repetative here, but what exactly is the charge that the officer is asking you to plead not guilty to?? You make it sound like a plea reguarding you hitting the pedestrian, not a liscense infraction, so I am a bit confused.

If the pedetrain was at fault, as they generally are, then I don't understand why you were issued a citation for the collision. I could understand you getting a ticket for not having an in-state license.
