I was just wondering if anyone knows anything about the sick time compensation laws in North Dakota. Anything to do with sick time or sick pay would be very helpful to me!!

If you have purchased a disability policy on your own you will have some income replacement if your condition qualifies. It is entirely up to your employer whether to offer paid sick time and if so, how much. The only caveat is that IF you are exempt, and ONLY if you are exempt, unless your employer offers a "reasonable" number of paid sick days, your salary cannot be docked if you miss time due to illness. However, if your employer offers reasonable paid sick time (generally defined as five days or more) then if you have used up all your sick days or are not yet eligible for any, you do not have to be paid if you are absent due to illness. A non-exempt employee never has to be paid when they do not work (with very limited, state specific exceptions that do not apply here) even if it is because of illness. ndworkingrl 10-03-2006, 07:12 AM Where I work you have to be sick 2 days to use 1 day of sick time. Some of the other employees were making a great big fuss about it and I wanted to make sure what my employer was doing is legal. One of my fellow employees said that because they allow us to accumulate it they have to allow us to use it whenever we please. Pattymd 10-03-2006, 09:17 AM Your fellow employee is incorrect. As cbg already stated, there is no law that requires your employer to even offer sick time pay. Therefore, the employer can set the standards for when it can be used.
