View Full Version : My husband is being harrassed Oklahoma

Hi Folks:

My husband works for a large company in Mcalester going on 11 months now. Since his hire date he was working under an individual who has made his daily work tasks difficult performing such things as kicking boxes purposely in his direction as he is walking, calling him foul names such as A**hole, Pr*ck, etc. He went to the manager above this individual and informed him of what has been going on the last 11 months. Now this manager does not know how to handle the situation and told my husband that he is too stressed out to deal with this. The manager he reported is not liked very well by several other employees and is just an electrician (not HR or upper management). My husband is on call 24/7 for this company as that HVAC tech. He clocked in 3 minutes late the other day after spending 4 hours overtime in the middle of the night. They want to write him up for being tardy and we believe that it has to do with my husband reporting this other manager and the fact that the individual above him can not handle the pressure of reprimanding a long term employee. Also, the employees of the company have brought the Union in and I believe that the employer is filtering through the individuals that are interested in what the Union has to say such as my husband and 56% of the remaining staff. This company is a 24/7 running business - non stop. My husband has been applauded for his work and the fact that they have not had to call in any outside help to keep their large HVAC units running at all times. What can he do? The upper manager can not handle my husbands denial of signing a written warning on being tardy. He turned in his company supplied cell phone and informed them that he will no longer be on call since this was an option not mandatory. He is meeting with HR today - does he have any rights? Thank you for helping us, the good ole boy system seems to be running this business instead of true hard honest working individuals. Again, this is a huge company.

Meeting with HR is his best bet. Nothing the co-worker is doing violates any laws - this does not meet the definition of illegal harassment based on what you have posted.

In addition, even if you are 100% correct that their writing him up for being tardy is related to his complaint to the manager, that does not constitute illegal retaliation in this instance.

Thank you, however, what if they are doing it because he has attended the Union meetings, which just started two weeks ago and coincides with his manager complaint. It is amazing to me that long term employees at an established company are permitted to treat new employees this way and get away with it.

If this is happening because he's attending union meetings, that's a different story.

How do we know, they could be using his tardy from a month ago as an excuse?

His tardy of (3) minutes. To tell you the truth, I've never heard of anyone getting a tardy for less than (5) minutes because, hey, our clocks aren't always in sync.

There's no way for us to know. He's free to take his suspicions up with HR.
