A few months ago my boyfriend had moved in with me. the agreement was that we would split the bills and rent 50/50. We had been talking about marriage and a few weeks after he moved in we found out that I was pregnant. About a week after, I was informed by my landlord that I had the opportunity to renew my lease. I talked it over with him and we agreed to renew the lease based on him agreeing to stay there because I could no longer afford the place solely by myself. Approximately 10 days after renewing the lease he packed up all of his things and left, while I was out of the house. A week later he returned, only to stay home for 24 hours and pull the same thing again. He has been recieving mail here, we have a joint checking account, and I have neighbors who are willing to write letters staing that they have seen his vehicle at the house overnight for well more than 30 days. I also have friends who are willing to write a letter stating that they had come to our home several times int he last few months and that he was living here. I never asked him to sign anything because we were talking about getting married, I was pregnant with his child and we were a family. It would have been like asking your husband to sign a lease. I want to take him to small claims court for half of the rent and bills for this month and half of the rent for next month, since he gave me no warning. Please help! I don't know if this is something I can do, or if he is legally protected.

If he was on the rental agreement, he owes the landlord money for breach of contract. If he is not on the lease, I think small claims court is all you can do, and you may be able to get half of the rent for the duration of the lease, since you are obligated to stay there for the remainder of the lease time. I am not a lawyer, and this is only my opinion, so stay tuned for more answers that may be very knowledgable.

If you can't come up with the rent, then the LL will evict both of you. Now, if you can come up with his half of the rent and bills, then you can take him to SCC and sue for the half he owes you. Bring your lease to court as it will confirm that you had a living arrangement.
