View Full Version : Can I renew lease without husband on it?

HELP!!! To make a long story short, I am getting ready to renew my lease for the fourth time here in MI. After the second lease, my husband and I seperated for 1 year and the third original lease does not have his name on it. We tried one more time to work things out, to no avail. When he moved back in, we went to the office and they had him only initial certain areas of the third lease. Things have went very bad between us and I had to have a Personal Protection Order put out against him and he no longer can enter the residence. The order is in effect for 6 months(April 07).I will be renewing my lease by Oct. 01, 06 in which the PPO is in effect. My leasing office says that he has to sign off the lease in order to get him off the lease. I had the doors rekeyed to prevent him from entering when I am not here, but they also said that if he asks them for a key, they have to give him one. The office said that if he does not sign off the lease, the only thing I can do is sever ties to the current apt. and move into another to avoid him being on the lease. They claim that they have to abide by their laws and that they don't want to do anything to infringe on his rights. I have looked over my lease and the only thing I can find that covers this is "unless I am entitled to terminate the lease under some paragraphs(which don't apply to me) I won't be released from the lease for any reason--including but not limited to seperation, divorce, reconcilliation, loss of co-residents, loss of employment bad health or death". I feel that since I do not have the PPO against me, I should not have to move in order to get him off the lease. Does it matter that when I originally signed the lease I was the only one on it? He was added on 6 months after it was signed. I now regret my decision to put him on it, but I was only following the rules and didn't want to get caught having an unauthorized person living in the apt. We are not going to reconcile and it just seems that if the PPO is in effect when I have to renew the lease, I should be able not to include him on it. You might be dealing with lower level management who work with limited knowledge and or ideas. It does not matter what we think. They are running the show. Try asking them to give him a 30-day notice to confirm is address or vacate. (Have them address it to your current address). If he does not renew then he is not a tenant any longer and they can take him off the lease, since the lease has expired. You then sign a complete new lease, not a renewal. It could be that they just don’t want him off the lease, because they want two collectible tenants in the event that there is damage to the apartment. Another option would be to wait until the lease expires and just sign a new lease this is probably the simplest way, but they might just be too paranoid to see it.

Thanks so much for your advice...I will ask them to do the 30 day notice to confirm his address, that should work because he doesn't even come to get the mail. Once again, this site is awesome and I have told many people to check it out, I have always been helped so much with any problem I have had. :D
