View Full Version : how do I get people out of my house? California

i and my 2 sisters own a property that was left to us in my fathers living trust. in the trust it says that we all must agree to do anything with the property including renting it out. On a trip to the house i found a family living there without consent from myself or my sister, although aparently this family was given a verbal ok from my other sister. I and one of my sisters want this family removed. they have no written rental agreement and myself and one of my sisters were completely unaware that these people were even moving into our property. I served these people a 3 day eviction notice, they are refusing to leave, What do I do?

I'd suggest you contact a local attorney. Who actually owns the property? You and your sisters or the trust? If the trust owns the property, then who is the trustee of the trust? Generally, if the three of you are co-owners of the house, any one of you can move in or move someone else in. That's why co-ownership situations can be fraught with problems.

the property was left to the family trust, where the trustee are myself and my two sisters. The trust does state specificly that nothing can be done to that house including selling, or renting the property unless all trustees agree, in which case we dont.

Then I would contact an attorney as stated above, it will be a fight to get these people out!
