View Full Version : Removing someone as a joint tenant California

Hello. I have an issue regarding my Grandmother will and grant deed. She just recently found out she cannot leave her property in a will because she is a joint tenant with her son. Turns out she did not understand what she was signing when she allowed him to be a joint tenant.

So, she asked her son to remove his name from the deed and he is fighting us and saying no he won't and when something happens to my grandma he is threatining to kick myself and my aunt out of the house (we live with my grandma, her son lives in Arizona).

He has never paid any money for the house, my Grandma paid cash in full for it, pays the property taxes, and now we don't know what to do. My Grandma does not want him to sell it, she wants to leave it in her will and wants him taken off the deed.

Is there a way? Any person I've asked aabout have given my a different answer every time.

Your best bet, and really, only bet, at this time is to contact an attorney. One who specializes in real estate, or in wills. You can ask people's opinions right and left, but at the end of the day, the only opinion that matters is the law's. Most attorneys will do a free consultation. This will at least give you an idea as to what you can or can't do. Good luck.......
