View Full Version : Oklahoma - Property Repairs...

Well as stated, I am in oklahoma.
I have been renting from my landlord for about 3 months now.
A month ago, the Dishwasher that was here when we moved in, started to smoke. We have not used it since then, and I have verbally explained to my landlord, that she needs to contact a repairman to come work on it (I have contacted her over the phone 3 times about it). Each time she said she would, but has not kept to her word.

Is there something I can do about it? I have been told by different friends, that I can, and that I cant. Some say, since it is part of the property, it is her responsibility to repair it. Others say, there is nothing I can do about it, since it is not a necessary fixture (I.E. Water Heater, Air Conditioner)

So again, is there anything I can do about it?

You rented the accommodation with a working dishwasher. The landlord is obliged to repair or abate your rent to compensate you the dishwasher not working.

Mention to the landlord that you want your rent reduced until the dishwasher is repaired - or if the landlord does not have post dated checks and you have to make payment each month, suggest to the landlord that if repairs are not made in 10 days, you will have the dishwasher repaired yourself and deduct the amount of repairs from the rent.

This will probably stir the landlord into action and get your dishwasher working.

She is coming by tomorrow for a house inspection, and I figure I will speak with her directly about it, and I will mention it to her then.

One last question, I was reading about Normal Wear and Tear of carpets. Some points that the documents made where like, moderate dirt/Spotting is normal wear and tear but a leaking aquarium/or a pet urinating on the carpet isnt.

I have 2 children, and the younger one is 4 years old. He got into the front room and spilled his orange soda on the carpet. Even though we cleaned it up as quickly as possible, it still left a Tinge of orange in the carpets. Yes it is noticable, without much effort in looking, and its about 2 inches wide and about 5 inches long. (Dont know if the size of the spill really matters, but figured it would help give an idea of the size of it)
Would this be concidered normal wear and tear? And yes she knew I had 2 children and my son was 4. So nothing was hidden from her.

Hold on before you act. According to the Oklahoma landlord act your LL may include clauses in your lease making the repair of appliances your responsibility. In addition, you can only deduct for repairs under 100.00 dollars. You must notify your landlord in writing and allow 14 days for the repairs to be done before you can deduct. It is likely that your landlord may elect to start eviction proceedings soon afterwards so, make sure you follow correct repair and deduct procedure.

P.S. Tang on the carpet and dirt is not normal wear-n-tear. The landlord will deduct for damage, cleaning and repair to the carpet including cat pee.

You cannot blame the landlord for renting to you and assume that she would have known that the kids would damage the apartment. It is illegal to discriminate against families with children.

Did you try resolve on the carpet? Works wonders on regular soda, probably will help with the orange too...
