First off Hi to all who have suffered through this process.....I was raped two years ago by the California court system .....Partially my fault, Had no attorney..( Could not afford 5-10,000 bucks)
I was divorced and seperated leaving her with leaving 20 grand and all house items.
I recieved 18 grand of credit card debtfor me , I was making 3600 a month, they gave her 700 a month as she claimed she could not work, more like wont work
So i refused to pay and have not paid
Icing on the cake is that during this time,
She had another credit card stashed that she ran up 10 grand and has not paid for 8 months and ruined my credit score and i have to pay or they will ruin my credit for life.
Great system we have here.
Now i know why people dont pay.
At least a robber gets it over quickly...
Now i hear she wants to garnish my wages, How does she do this and is it possible?

Does anyone know the length of time one should have to pay alimony.
We were married for 12 years, is there a formula or something else they use in California..thanks

You have specific legal questions. You need to talk to an attorney, preferably the one who handled the divorce for you, since he or she knows all the facts.
I don't practice family law, but I have heard that alimony is presumed to be appropriate if the marraige lasted 10 or more years, and that alimony usually lasts for half the duration of the marraige. If she has a judgment against you for the alimony, she can collect it by garnishment.
And, strangely enough, the vast majority of the legal professionals on "Labor Law Talk" specialize in Labor Law, not Family Law, so very few respond to the family law questions.

So, you had a court order that said you must pay alimony, yet you deliberately chose to defy the order. Well, once again, that is your fault. You need to get an atty about the credit card debt. I don't know how any debt she has accrued since the divorce is final could legally be held to be yours. If she had the credit hidden, then that is something the court should rule is HERS and hers alone. However, as far as the alimony, yes, you wages can be garnished. She will file for contempt of the court order and the judge will decide if it is reasonable to issue an order to garner your wages. As you stated that you refuse to pay, you have just given the court excellent grounds to take this action against you. It is a legally owed debt. Unless you can get a court to throw it out (HIGHLY doubtful at this point) you have to pay it.

My gripe is that Judges should actually talk to people and should judge, not just rubber stamp the papers. Maybe even get them counseling to better themselfs. I also think we have too many free tickets as my ex is just getting a free meal ticket with a nicer truck than I and car as well, yeah its a great world we have created to leave for the future..Dam Im Proud:eek:
