We have already been to court on this once due to the judge not being there we had it moved up to oct.We have had our home eval the casa person states in his report the child should stay with the mother even though she has been arrested for domestic violence and on probation for assault the man she lives with has too been arrested for domestic violence. The child has been molested by other children twice in the past six months once from her half brother who is 7 and once by a thirteen year old girl this all happened while in the mother's care she did not report it the second time my husband did to children services we do know the child was taken to the children''s advocate center and there she did tell them what happened to her the mother claims the first time it happened with the half brother that she took them both to the emergency room to have them checked out and from there they called children services on her we do not know the outcome they will not give us any info but we do plan to have the records in court for the judge to see but we also pulled the child s medical records well we did not find the record that she claimed she took them to the hospital we feel she has lied to us and they were not checked out and we feel she may not have reported it either but with all this we feel she should be with us we are married and have other siblings she has bonded with in the home.My question is if she did not report any of it I read that is against the law.Is It? The childs mother does have alot of cases on her from the childrens services will the judge look at these and even though some are closed will he ask the question we do why is there so many? I just would like to know if we do have a good chance.I just worry about her so much and wonder what will happen to this poor child when she gets older she just turned 4 yrs old.We also have a witness that spotted the child on several occasions outside alone in the road ,playing in the car she is a neighbor of the mothers who works with my husband and chased him down at work to tell him this did not even know him when we had her in court the attorney made her she was sitting with the mother and asking why she was there.I do not understand why she now acts this way after she was so concerned about the child to tell the father this.But I just pray the judge understands our concrens for the child the mother does not plan to take her to therapy she says the child has forotten well she has not she is talking about it and she has been doing things not normal for a child her age.If you have any knowledge on this please help thanks

You have to -HAVE TO keep calling CPS. Child protective services in TN is not the best organized and is so overwhelmed that it is up to you to call and call and give them all the evidence. I have heard that sometimes the cases are not linked (like if the mom uses a different last name). You need to explain what is going on and that you want to take the child.
Emergency room records may not be in the childs regular medical chart from the doctors office. You would have to go directly to the hospital and get those records(well dad does). Hospitals keep thier own records and it is up to the patient(or in this case the little girl's MoM) to say please send a copy of that report to our regular doctor.
If CPS refuses to tell you anything (which you are the step-mom and I assume your calling) that is normal. Your husband should make an appt. to go to thier office and discuss his daughter's case.
If the mom did not report it, that is neglect. Has the 7 year old been removed from the home? (I suspect that the 7 year old was probably molested- he is too young for it not to be a "learned behavior") All the violence and sexual crap -NO CHILD should have to live in that kind of envornment.
Remember when in court stick to the fact and what you have documentation of: witnesses can swing the other way. (maybe the neighbor/co-worker got in a fight with the mom and now they are back to being drinking buddies again-who knows?)

she does not have a doctor that we know of the mom takes her to the emergency room on most cases we pulled them from both local hospitals and the 7yr old boy lives with his real dad she just has visitation with him and that is when it happened while in her care she was not watching them and later she found them in the closet and you know what she found both naked and him in the act.The father has called children cservices and they won't tell him anything either.I just pray we have enough even though the court appointed casa recomends she stay with the mother he states her criminal record is petty and he also knows the mother lives with the man and not married to him but the boyfriend has even stated to me that the mother does not watch her that he come home from work and she had climbed iup in the cabinet and had ten pieces of gum and he said right beside were she got the gum was all the medicines and that she could have easly gotten them that the mother was watching tv and did not know.Any way it is a mess and this is a new judge just voted in to the office hope he does not see this stuuf as minor the last time the father seen her she was trying to place his hands on his privates and was laughing about it.So she she has not forgotten any of this and we hope that she does not try to do this stuff with another child and think it is ok too since it was done to her that is why we feel she should be here so we can get her some therapy and teach her in a loving stable home the mother says she throws fits on her and she can't control her and calls us to come get her that her boyfriend is kicking her out so she is not in a good enviroment at all.

The court appointed CASA is there represent the child's preferences, no matter how bad the environment is - they are there to make sure the child is heard. However, there should be someone like CPS to represent the child's BEST INTEREST, which is a different job. Keep calling CPS, have dad get the medical records, start building a case. Keep a log of what has happened to the child, what the child has told you etc. It's unfortunate that you have to do the state's job, but it looks like it's necessary in this case.

You may wish to get the child in therapy -NOW. Make the appts. for when the dad has visitation. Counselors are manditory reporters. CPS will take a therapist more serious than a parent. IF you believe the child has not been to see a doctor aster this occured, take the child to a doc asap. A regular pediatrician. Every child should have a pediatrician how else can her immunizations be up-to-date etc... Doctors are manditory reporters also and again CPS might take it more serious than a parent.
Even if she has "forgotten" the event specifics, the signs of abuse are there. It is "normal" for abused children to touch others parts that they shouldn't because they think it's okay, or a game, or just don't understand the implications of what they are doing.
The court will look at your actions (taking the child to doc, therapy, etc) as in the "best interest of the child".
**But before you take the child to the doc -double check to make sure that the Dad has the right to make medical decisions in the custody/visitation papers.

We have also pulled criminal records on the mother and bf and seems they both were arrested for domestic violence one on the bf is recently the mother also has a assualt charge and was put on 6 months probation.Between the two she has a domestic arrest and assualt , and filing false police report charge he has the recent domestic violence and another domestic violence on his niece who was 16. Just wandering if the judge will look at this as an issue as well. Update on taking the child to therapy my husband tried due to him not having custody to sign the legal paperwork he cannot take her so that is a lost cause. Hopefully the mother will tell the judge the same thing about her forgeting it and hopefuly the judge will make her take her even if we do not win this. I pray we have a good chance. I nor my husband have any kind of record with any arrest or domestic violence.
