some backround, I am getting ready to marry a man who was divorced in Mich in 91- he just left the state- never saw a copy of his divorce papers, and never had contact with his kids until this year when we went to visit them since they ar enow grown and she can't stop them ( but they still have to hide it from her). anyway ex-wife remarried shortly after divorce and recently she filed for child support all the back pay, they are now taking about $500.00 a month from his check every month and he only makes about $9.50 per hr- since the 2 kids are now adults ( 1 was still a minor when she filed but has since turned 19yo). can the amount be reduced since its not current support for a minor child?. And one additional surprize when I requested a copy of the divorce decree the judge had awarded custody of the 2 children to their Dad, a mistake i'm sure but still a legal document which she also got a copy of and never challanged, will this matter- this is just a mess!!

The fact that he was awarded custody is neither here nor there since he never saw them. She raised them. And paid for them herself. Secondly, if his children are grown, he is obligated to pay back pay, but not current. There is no 'current' obligation if there are no minors. In the divorce decree, this makes a BIG difference, was there language pertaining to child support? I understand it says he had custody, but was there something about support? Was he ever ordered to pay child support prior to the recent order? I mean, is the current order the only that has ever been filed? It isn't a modification? If you could answer these questions I can give you a better answer.
