I was terminated in January of 2006. I worked as a Phlebotomist at a Hospital. I got into an altercations with a relative of mines. Where I knew that I could never trust her. I had been raising her kids for the past 15 years and legally adopted them. I recieved a phone from my daughter stated the fact that she has to admitted in that night. I was viewing the system to see how many patients we had in the hospital, So that I would know if we would have a hard day. I say her name. I said to myself that seems to be my relative. I waited and told my office manager that I had an altercation with her and that I need to make sure that it was her. I ask my office manager to verify it. At the same time. Another co-worker was sitting at the computer logged and stated some information about some lab test that were done. I only knew her birthday. She did and said that the birthday matched. We proceeding to do nothing. I told her that I would not go to her for any reason to draw her blood sample. Because she could say that I did something to her. I avoided that situation at all cost. I told my co-worker and something was not right that day. I had to draw samples from other patients on that floor. But I didn't have to go on that side. I had a co-worker that was terminating her employment that Friday. This happened on Thursday. My co-worker went into the room with no orders to draw my relative. She had no reason to be there what so ever. I proceeded to do my job with no evidence to do any thing but that. I returned to the main hall. I didn't see my co-worker. So I proceeded back to the lab with my samples. About an hour later she comes to the lab and started talking about the reason she was there. I told her I did't ask you for that information. I don't care. I worked that Friday early morning. I was leaving town for a funeral so I told my office manager that I would see her when I get back. I recieved a phone call from her that evening. I was scheduled to get my bus back and return home the next day. I left sooner to be able to address the issues before me. My co-worker was terminated also. The co-worker that went up to the room to see my relative had co-erced my cousin into calling back to Human Resources. Tell them that we were in the computer, looking at her personal information and we printed up information. That did not happen. Once the birthdate was acknowledge the situation was closed. That we could take that information as pass it out. My co-worker that was leaving the job had called off that Friday. Never to return. I came in the next day once I got back. I called my boss to tell her that I would be there shortely. I got there and was asked what happened. I proceeded to say. My boss said don't lie. I looked at her and told her for what reason am I being terminated. She said because you looked in the system. I told her I had no knowledge of finding information in the system. I told that you have made up your mind to terminate me. Give me the paper to sign it. I gave her my badge and key. I told that I could not believe that you would take anyones word for this unless you investigated the situation. They presummed first.
I said I have worked in the Hospital system for years don't you know that I know the laws.
What violations come with this. I would losed my job over this. I avoided this.
My boss was aware that my co-worker and office manager had a huge altercation. Because she told my co-worker to stay clear of her. I was aware because she brought it my attention. After I signed my pink slip. They asked if I had anything to say I said no. I turned around and said I will tell you why this happened. I stated the circumstances. I told told them that I avoided this at all cost. I walked away. I was prn, but I worked for the past year forty plus hours a week. I was called in at all times. I never refused to work. I was a dedicated and hard working individual. I will walk. But I have had a hard time finding a job. I did file for my unemployment and I did recieve it. I was appealed I won that appeal to. I have exhausted all my funds. Now they want to have a third appeal through the Board. I will attend in person. The co-workers that actually went into the system is still working and lied and said that they did not go in the system. I was looking at them. I didnot log on. I was just standing behind my office manager looking. I got terminated for looking and my co-workers are still working. Unemployment state you terminated unjustfibly. They had no proof. I didn't log on.

If I am reading this correctly....

Are you covered under some sort of a union or collective bargaining agreement?

If not, your problem boils down to this... I think.

You were accused by a relative of inappropriately viewing her medical records. Your supervisor terminated you for it. You went through the unemployment process and it has gone back and forth 3 times.

You are now wondering what else you can do.

I don't think you can do anything more than what you are doing. File for unemployment and look for another job. You can be terminated without cause or reason.
