View Full Version : Collecting support after death of custodial parent

My parents were divorced when I was a child. Mother stayed in Ohio, father moved to Florida. He would pay support here and there, but owes over 50,000 for my brother and I. My mother passed away and now he states that he no longer owes this money as it was owed to my mother and not us. By the way, we are both well over 30 years old. Could someone tell me if this is the case or not. He had been paying here and there up until she died.

that money was owed to your mother not you or your brother- dad just may get a free pass on this one

When we turned 18 we had to sign papers that we wanted the money collected and not stopped. So you mean to tell me that as long as a father can get out of paying support long enough that that the ex dies he doesn't have to pay anymore. That is bull! :mad: We suffered all our childhood, and lived on welfare because he was lazy and found ways to dodge not paying.

Sorry not to get upset at you. you are just passing the bad news. This really infurriates me to no end. I would not care if an attorney took every penny he owed but I think he should pay what was owed.

well if you guys were on welfare it's likely that he will have to keep paying- to the state- to reimburse them for the benefits you received....but you are unlikely to ever see any money- cs support is a reimbursement- and you have nothing to be reimbursed for....

Please consult an Estate Attorney (one that is certified)

This money is a debt owed to the estate and may be enforceable as such under your states inheritance and estate laws.
