View Full Version : breaking month-to-month lease mid month New Jersey

My lease has expired at the end of April and was never renewed. But I kept paying my rent regularly. I need to move out on October 15 and left my landlord a message about this in late August. He called me back today (Sept 13) and said that I can not leave mid-month and will be responsible for the whole month of October if he can not rent the apt from Oct 15. Is he right? Or do I still have time to send him a 30-day notice and pay only through Oct 15?

Many states require that you give your notice of intent of vacating on the first of the month. Check your state rental laws, but there is a good chance that if you where to put in a notice tomorrow, then you will be able to move out on the 31 of Oct.

Since the lease has expired, you MIGHT get lucky, and have 30 days from the WRITTEN notice.
