Hi, Me and my daughter left her daddy two weeks before she was born.
We were leaving over at his moms house.
1.) There's no custody yet but I have my daughter. What is the chance of him getting my daughter back?
2.) What is the chance of me paying child support if he gets the custody of our daughter
3.) Can her grandma get custody as well?
Please advise. I have not file any custody yet cause I don't want to go back and forth to court. I want to have a clear understanding with my baby daddy.

Well, the only way you can guarantee that you and the father have a clear understanding is through a court order. Were you and the father married? (or are you still?) If not, has paternity been legally established?

we are not married. he signed the paternity though.

Okay, he is the legal father. You need to file for child support and a court order dictating custody/visitation. If he were to be awarded custody of the child, yes, you would be responsible for paying child support, just as he will be if you retain custody. Why are you so worried that he will get custody? Unless you are deemed to be unfit, the odds of him being awarded primary custody are slim. He will most likely be awarded visitation and joint legal custody. The only way the grandmother could get custody is if both of you (the parents) are deemed to be unfit by the court. As he is the legal father, if you don't have a court order dictating WHO is the custodial parent, if he takes her, you will have a very difficult time getting her back. Without the custody order, you are in a very precarious situation.

Hi thanks for your reply. I'm just really worried because I don't want to file custody. I don't want to go back and forth to court. I actually want him to file this kind of stuff but I don't want him to get custody of our child. Therefore, I'm just kinda sitting here waiting if he will file custody of our child. His a very irresponsible person and if he really want to have time for his daughter he will file custody on our child. Really, I already told him I don't want anything from him but just to leave us alone. Although he said he can't leave us alone I told him then he needs to support his child. Buy stuff that she needs and pay part of child care. But anyway, at this moment he has not giving us anything which doesn't bother me right now. I don't want to keep on asking him for stuff as long as I have my daughter I'm happy.
