I am on a lease with a roommate with our landlord. Roomie has not been paying utility bills (to the point of disconnect) and I want him gone. Landlord seems rather indifferent to the situation and puts up with roomie paying rent late too. Our lease is not up until December, and I don't know if the landlord would tell the roomie that he won't renew for him but will for me alone, nor do I believe he would want to go through the hassle of eviction over the late rent, because the landlord always eventually gets paid (while the utilities never do!) I want to stay here and force the roommate to move, what can I do, if anything?

Talk to the landlord. I just went through this and to keep everything above board, I did not renew the lease. Had both parties move out (the one that wanted to stay went to her parent's place for a week) and then I allowed her to sign a new lease by herself and move back in. I was more than willing to get the bum off the lease and have never been happier.

We talked to the landlord the other day. Apparently the roomie has managed to beg and borrow enough money to catch up on the rent, so the landlord doesn't care about whatever problems we are having. His words were "looks like you'll have to fight it out yourselves". :rolleyes:
So in a nutshell, we're screwed.

You may not be able to have the landlord throw him out, but that doesn't mean he can't be made to pay the utility bills that are owed. You can file a suit in small claims court.

Tell the roomie that YOU are not renewing the lease and that they need to find another place to live. Tell them you will even cover November/December if they will get out early. Then sign a lease by yourself after they leave. Just let the landlord know that you do want to stay but you are trying to get the other one out so he doesn't rent it to someone else. Good Luck!!
