View Full Version : husband wasn't properly served. Help!!!! California

My husband lives in CA and me in another state. I ran away from him .We've been separated almost 2 years. I filed for a divorce and a co-worker of him promised to serve the papers to him. The co-worker has to sign a form to show that my husband has been served. However, when I tried to contact my husband's co-worker, he cannot be reached anymore and all he said in the email is that he cannot sign any papers. I talked to my husband recently and he said he will sign the papers but told me he has not recieved any yet. Unfortunately, my husband is a liar and he was controlling every aspect of my life. I know he still wants to jeopardize everything for me.

Our divorce is uncontested. We have no kids together, no properties, I am not asking for spousal support, I cannot give spousal support and my husband knows that. All I want is to be legally free from his shadow.

Now that I cannot have the st&pid co-worker of my husband to sign the paper that says my husband has been served, what can be my best option? I haven't talk to the legal assistant working on my papers because I am worried that I cannot request another document to serve my husband in CA. Would it be possible that I request another document? Please your help would be highly appreciated. Thanks

You need to redo all the paperwork and have your husband properly served. I highly advise that you use a legal process server rather than a friend or co-worker. A licensed process server will be able to make service and it cannot be disputed.
