View Full Version : If you give up rights, will you still have to pay support? California

My boyfriend has a 4 year old daughter that he has never met. He has paid child support from the day ordered, although at every attempt to see the child, he has been turned away by the bitter/angry mother. The relationship between my boyfriend and the mother was soured when she told him she was pregnant after he was under the assumption that she was on birth control pills, taking them regularly and he realized at that time that he had been trapped. She was very aware that he did not want to have children and that he and I were becoming closer friends. I have been by his side from the beginning, we are in love and live together. She despises me and "us" and makes every day a difficult one. We are exhausted and need to know......If he signs over parental rights, will he still have to pay support??

Does your BF have a court order for visitation? If he does he needs to file for contempt. If he doesn't he needs to file for visitation rights.

He will not be able to sign away his rights unless the mother has a husband who is willing to adopt. If that is not possible, then he'll have to continue to pay CS and he needs to either get court ordered visitation, or enforce an existing visitation order.

He can not sign away his rights unless mom has someone willing to adopt the child, and in most cases mom and step dad must be married for a least one year.

I want my son's father to give up his parental rights and need to know how to go about doing so. This is my second attempt at this and he told his wife to tell me to file the papers. My son is 12 and only seen his father once in his life time. His father blames everyone for the mistakes he made, refuses to report to the child support office his where abouts and currently has a warrant for his arrest since January 2004 for not appearing for a child support hearing. He is currently in the arrears by $33,276.18 and is not even trying to pay support. This has been going on for 12 years. He has promised my son that he was going to be there as a father for him but has failed to do so. I recently found out from his wife who is having the same problem with him, that he stated that he tried to reach out to us but we never responded. This to my knowledge is false. I believe that if we had a number for him I would have let my son call him. I spoke with his wife today and asked her to have him give me a call due to my second attempt to get him to give up his parental rights because I am tired of putting up with the lies and seeing my son upset because other kids are spending time with their fathers. I need to know who to go about this process and by him giving up his parental rights will the child support arrears go away or will he still be responsible for it.
