View Full Version : Negotiate w/Attorney on remainder $$ owed California

Does anyone have any suggestion to where I begin and how do I go about it. I still owe my attorney 90K and it's going up every month due to interest. There is just no way I can pay that, and am trying to find someone who has had to negotiate to a lesser amount. I'm not working and have a child...so no income, except for support and that's not enought to cover bills. Help.

Have you tried explaining your situation to your attorney yet? If not, try writing him/her a letter of explaination with an offer to pay X number of dollars each week/month, and ask that as long as payments are being made that the interest will stop accruing.

If your attorney won't work with you at all, there are only 2 other things you could do: get a job to make payments (as long as you are making regular payments I doubt that the attorney would take you to court). Or- file bankruptcy.

With your situation and the amount, I would strongly suggest looking into filing bankruptcy. There are many attorneys that give a free initial consultation and a simple one could possibly be affordable. It would also be possible to get one from your local legal aid at no cost. Worth looking into unless you have recently filed (7 yrs I think).

What about trying to file a motion for the ex to pay your legal fees or asking for an accounting as to why the amount is so much? Are these only your attorneys fees?

Thanks for the info. I have recently been putting a letter together for my ex attorney, I just was wondering if anyone else had to do this and what is the best way to write it to get the best result. I have been trying to get a job, I just recently graduated with my degree, however I was trying to take care of this situation before I truly get into a good paying job. I walked away from my divorce with nothing, and my ex got quite alot, stock and much more. So I feel that the amount that I owe my ex attorney is unjustifed. And was hoping to pay much less. I will not file for bankruptcy...many people have suggested that, my ex husband ruined my credit and I've been trying to put it back together and I won't ruin my credit further for many more years to come.

Thanks for the info, but I can't file bankruptcy, I've been trying to get my credit back on track after my ex husband destroyed it for me. Won't do that to myself and my future.

Unfortunately, the reason my bill is so high is because of my ex's attorney's (yes Attorney'S) He had the sending us paperwork after paperwork, and I told my attorney to write them a letter stating that we will not respond to any more frivilous papers. But of course he never did that because that was just lining his pocket as well. After I pleaded with my attorney for months to file a motion for me ex to pay for my attorney's fee's he finally did it but the judge was so pissed at us already that he only gave my attorney 15K to finish it up which didn't amount to much and then he excused himself from my case and I had to finish it up. So unfortunately I can't go back and have him pay for it. And yes they are all of my fees. He sent itemized statements to what he was doing and most of the statements were responding to cousels letters.

We fired our attorney and because he did such a bad job, we don't want to pay his ridiculous bill and outright criminal bill.

We are going to arbitration. You file for arbitration through your local bar - but we skipped that and went to the state bar because you can file hardship to not have to pay arbitration fees.

You can request a panel of 3: one attorney in your field, another attorney and a layperson to hear your case.

You can also file and request this arbitration be non-binding so that in case you don't like outcome, you have other options.
