My friend is being harassed and threatened by a private child support collector called supportkids.com. His ex went to them and they are threatening him with jail time or suspension of his license. They will receive 15% of whatever monies they collect from him.
My question is, is this legal? can they really send him to jail as they are just a collection agency? Can they suspend his license as they are not a governmental agency?
He has visitation as well as was paying support rather than be garnished at work. He speaks to the custodial parent all the time but she did this with this company whenever she does not get enough attention. Shouldn't she be able to just stop it? Does he have to pay them when he is already paying her? Help!!!!ahahhah :o

To the best of my knowledge, they have no legal authority past what is empowered to each citizen.
In other words, if your friend doesn't pay what he owes, this person, or any other person for that matter, can turn his location, employment or other facts to the proper authorities for action.
If found to be in serious default, your friend could THEN be subject to a variety of penalties up to and including the ones mentioned. However, that is for a DA to decide.

Oh, and if your friend was stupid enough to pay child support without a paper trail (like a receipt), to the courts that money may as well never been paid.

Thanks. No. He has a paper trail. That is how he figured out who was harassing him. They had no record of all his legal documentation pertaining to the case. They started asking him questions as if it were day one. That is when he grew suspicious and started asking his own questions. Thats when he realized they were a private collection agency and not the California family courts.
He paid and still pays. He has been to court several times regarding this. The only time he was ever negligent with payments was when he was laid off and had no income.
He should not have to pay these collectors then, therefore he should also not be subject to any sort of ramification, correct? I mean this is not debt that he owes these people (supportkids.com) this is owed for his child through the family support court system.

I Know In My Case That Support Kids Would Not Take My Case If I Was Involved With My State Cs Enforcement. You Have To Have A Court Order To Get Thier Help However They Would Not Take Mine Because Of Cse Being Involved Unless I Dropped My Case With Cse. They Also Told Me They Can Not Throw Anyone In Jail Or Take Their DL But Could Let The Right People Know And They Might Take Action. When I Spoke To Them They Told Me They Do Most Of Their Collections Thru Liens On Property, Inhertiance, And Other Forms Of Money Like Casino Winnings. I Am Sure They Help Alot Of People But There Hands Are Tied Also. They Have Several Steps You Go Thru The First Being A Private Invest. Looks For What Ever Money He Can Find And So On. I Am Only Speaking In My Case. I Choice To Stay With My Cse And Not Use Them. (you Can Not Choose To Drop Cse If The Nc Owes Money To The State).

Last year my husband's ex went to Supportkids.com. They started sending him notices of lien/garnishment. We knew he was paid up so we immediately retained an attny.
It was an expense that we couldn't afford but we did it anyhow b/c the ex has tried to get double payments by defrauding the state(s) she lives in. Anyhow, our attny sent letters to supportkids advising them to cease and desist contact with us, that he was paid up (we provided attny with copies of payments made through payroll deduction in SC and cancelled checks we sent after the payroll deduction was stopped). It took a nasty gram from our attny threatening legal action against supportkids and the ex to get them to stop. (this went on for over a year and a half, but it was the best money we ever paid and the attny dealt with them not us) As we found out they don't like NCP's attny's running intercept and quit retuning our attny's phone calls.
With us they tried to use scare tactics to get him to pay the money but we knew we were in the right and it didn't work. I would still consult an attny ASAP, especially if there is proof of payment.

I am so sorry for not checking to see if my caps were on. My computer at work is set that way for everything I do. I dont understand why anyone would find that funny. We are all here to get advise and give it when we can
not make a big deal out of someones typing skills. I was on here once before a few months back and was made to feel like the blunt of the joke and here we are again. The funny thing about it is it is the same person again!!!!!!!!
Why is it you do this? I will make sure my caps are off in the future and maybe you will find someonelse to intertain you!!!!!!!!!!!!!!!!!!!!!
