I was divorced last year. My youngest son was 18 at the time of the divorce, but still had a year of high school to complete. He decided he wanted to live with his Dad. I was ordered to pay child support. He is now 19 years old and graduatated from high school. He has not enrolled in any college and has no plans to go to college. He's been out of high school since June and I'm still paying support to his father. I know he will automatically be emancipated when he turns 21, but my question is in the meantime since he's able to work and out of school do I have a chance of getting out of the support? I don't think his father will make him get a job as long as I'm paying support. Suggestions anyone?
Thanks.

Indiana Law - Until What Age Does Child Support Typically Run?

A typical age for child support to run is until age 21.

However, support may terminate earlier if any of the following occurs:

* The child is emancipated before reaching age 21. (Although in that case, an order to pay educational expenses will continue to be in effect.)
* The child is 18, has not attended school for 4 months, is not enrolled in school, and can support himself through employment.

Section 31-1-11.5-12(e).
