I had two back surgerys. One 30Mar06 and second 27Apr06. I had went to doctor due to past 10 years of back pain. Had a mri done and was told I had degenerative disc disease and bulging disc. I had physical therapy for 2 months and then finally sent to neurosurgeon. After a discogram and different xrays was told I also had scoliosis. I opted to do the surgerys, first one I had two plates and 3 bone rings inserted, second i had 6 screws and 6 rods put in. The first surgery I was in intensive care for 5 days and on a ventilater for 2 days due to losing 3 units of blood during surgery. The second surgery I was in Intensive care for 2 days. This was a very tough surgery. I was approved for std till 20Aug06. After twelve weeks I received a certifide letter stating that my FMLA was running out and my position at work could not be guaranteed. Called pr/hr and she told me don't worry she is just required to send letter. After I was released to return to work on 21Aug06 (20Aug was on a Sunday)I went to my work with my release and was told I no longer had a job. Not only that, I did not receive an exit interview (done to all employees who quite or get fired) and I have not received my last week pay for std. I did apply for unemployment but have not heard if I am going to receive this or if I am going to have to fight this too. My friends and family tell me I need to contact an attorney. Any comment on if I should or shouldn't. I have left a message with payroll on my last check but still have heard nothing. Good news is my back is a little better and my scoliosis is now only 20 percent curved. Thanks

I will never tell anyone not to see an attorney.

However, if you ran out of FMLA time, the company no longer had to hold your job.

There is no law that says you must have an exit interview, even if it is in the company's employee manual.

Are you a member of a union or some other CBA?

I agree with cyjeff that I would never tell anyone not to speak to an attorney.

However, nothing in your post suggests that any laws have been violated.
