View Full Version : Can a Landlord place an eviction on someone who has already moved out? California

So here's the deal, my name came off the apartment lease today, September 1st.

I have a roomate who is taking on the full rental amount for the apartment. A mutual friend of ours often stayed more than the legal "guest" amount during the time last year when I was on the lease.

The landlord is planning to evict my staying roomate and her friend because her friend was not approved for the apartment with her credit.

My question is can they also place an eviction against me since I let her stay more than 2 weeks last year? And also even though I have already moved out?

Your question is dependant upon your state laws...as a general rule, if your name is still on the lease, then yes you can be evicted. I would therefore consult with an attorney in my area to see what options I had.

You might consider writing the landlord a letter (sending it by certified mail with return receipt) explaining that you had already moved prior to the notice being issued and ask that he not include you in any actions he might take.

If things go to court, then I would bring this matter to the Courts attention and ask that you be dismissed from the case.

If back rent is an issue, this is a different matter for in most states it does not matter if someone is on the lease or not...anyone living there can be sued for back rent owed.

I just wrote a post in the General Section about an attorney being exposed for operating a money scam using the Courts...involving tenant evictions... read it and pay attention to any notices you receive....I would also be wise to any rights you might have under the Fair Dept Collection Practices Act regarding any back rent owed.
