Federal nor Texas labor code address meal (http://www.dol.gov/esa/programs/whd/state/meal.htm) or rest (http://www.dol.gov/esa/programs/whd/state/rest.htm) breaks. As such the answer to your question lies within your own company's policies. What does your company policy say on the matter? It would be perfectly legal to have a policy of "no" breaks.

child care has no rules .. even down to going to the bathroom we have to wait till a supervisor comes in and then go to the children's bathroom that is located in the room..

There is no law in Texas requiring breaks of any kind. It was nice of your previous employer to offer them but your current employer is within the law.
