View Full Version : Failure to pay 1.5 time in Wyoming

I work for a company out of Gillette, Wy. We basically pick up train crews and take them from the depot to trains to other trains and back, etc. We work 6-12s with 2 days off, because of this most of the time we only get paid for five days a week and that sixth day is overtime only when it falls that way. We get paid overtime after 55 hours and not 40 like everywhere else I have worked. I was told they can do this because we are technically Taxi drivers although this is really nothing like being a taxi driver. We have to keep DOT logs and follow DOT guidelines as far as rest times and drive times, etc because we drive 100s of miles. I know of NO Taxi services that drives as far as we do and that distance is the very thing that puts us in the same category as truckers, of a sort, as far as DOT is concerned. Yes we are an interstate company and fall under federal law.

Then you can file a complaint with the state DOL for unpaid overtime.
