View Full Version : HOA - need help with screwball California

I own an unit in a townhome complex and we have an incorporated HOA who does a good job of establishing rules and bylaws for the complex. However, this screwball living in one of the complexes has self appointed himself as the pro-tem president of the association. He did this even though we have elected member to fill all the positions. For the past 4 years, he continually sends post cards to all homeowners criticizing the elected members of the current board. He is not recongnized as holding any position on the board. He also holds special meetings in which he criticizes the elected board and everything they do. No one attends the meetings excpet him. We have ask him to stop sending us the "stupid" needless postcards, but he insist that as a pre-tem president, the law (code 7511) requires him to send out the notices. I personally ask him to stop sending the notices to my unit since I will be renting out the unit and moving to another state. California is the place where the unit it located. I don't want my tenant bothered with these notices and I refuse to give him my forwarding address. Isn't this harrassment since he insist on mailing material to us that we don't want? What can we do to make him stop the madness? Please help. :confused:

If he's using the mail to misrepresent the position of the duly elected HOA, the HOA might try contact the USPS postal inspector. If, in any way, he's managed to get dues/money from people, he's committed fraud. If he's just a crank (and it sounds like it is), the HOA may wish to have its attorneys send him a cease-and-desist letter and then take it from there.
