I recently had surgery to remove an unknown cyst from one of my ovaries. The doctor ended up removing my whole ovary and had it sent to pathology for a report to find out what it had been. About a week later I got admited to the hospital extremly sick and with a bad infection. When my new doctor contacted the lab to find out what the pathology report concluded we were told there was no report. Apparently not only was there no report but after searching about 5 times through the lab concluded that they never received a specimen and therefore I am faced with the unknown. Here I am 2 months later and they find another cyst on my other ovary and now I am told (by a new doctor) that without a pathology report or any information they are not comfortable leaving this alone and want to do another surgery to possibly remove my other ovary. I am only 26 years old and I am getting married next May and would like to have children. Anyway the whole point I guess to this posting is I wanted to know if anyone else has ever heard of or expereinced something similar. I plan on sueing the hospital but I am curious what my odds of winning are. Please let me know if you have any information or advice. Thank you!

Medical malpractice is specific to the facts of each case, so no one can really predict what the odds of your winning might be. The best thing you can do at this point is to consult with a medmal attorney in your area. Unfortunately, it does happen that specimens sometimes get lost.
