Hi,
I will try not to make this too long but I really need some helpful info.
We moved into a duplex on may 2 2006 (North Carolina). The current landlord has sold the property and as far as I know it is supposed to be changing hands today! We dont have a lease so it is a month to month tenancy. The guy who is buying the property has been comming over here several times a week for 2 months now...I don't know why he feels he needs to coma around so often but he does. Sometimes he brings people with him to discuss what he wants to do with the property etc...even when he doesnt actually come into my apt it is a bit unnerving to walk out into the back yard where i live to find several people wandering the property. Also neither he, the current landlord or the realty company gives us any notice that he is comming he just shows up. So about 3 weeks ago he shows up with 5 guys, workers inspectors etc...(I had been letting him in most of the times up to now because i figured i didnt want to piss off the new landlord right off the bat)
so heres these 5 people wandering around in my apt and this guy gets on his cell phone and tells someone yeah come on over I'll be here...excuse me? who is he to tell people to come over? Well that made me mad but I didn't say anything then...two days later he shows up again with an inspector. This guy starts going through my closets and cupboards and drawers which I didnt agree to so I said are you planning to go through ALL of my closets and drawers and he says yep why do you have something to hide. Now I'm pissed cause i dont need to be treated like that for cooperating...so the guy that is buying the property says to me oh he needs to find everything wrong..we are just trying to get the place fixed up so it will be nice for you. So I put up with it...2 days later i get a letter from current landlord (Aug 6) saying please move out by Aug 24 ( my rent is paid up until sept 2) At thisw point I decided I no longer want to cooperate with him..why should I? He has still kept showing up almost daily now but I have not opend the door for him....last thursday a construction crew knocked on my door at 8 am (no warning) I told them you are not comming in! An hour later the current landlord calls and says that letting them in is NOT optional. I didnt let them in. Little later landlords wife calls and says if we dont let them in we are going to have a problem. My husband came home from work and spoke with them and did let them in. They were here all day friday and saturday and then on sat asked if they could come back sunday to finish up an hour or so of work...we said ok...they showed up 8 am sunday morning and left 8 pm sunday night. On Monday the guy who is buying property shows up again says he has to get in to check their work...we were on our way out the door to a doctor appointment and told him NO. He tried to get in anyway as soon as we left...we know this because he complained to us about not being able to get in....this guy is not even the landlord at this point so how is he going to treat us when he is?
Anyway my question is: Do I have the right to not allow him in. I understand that laws say you have to let the landlord in with reasonable notice...so for now I am within my rights because I haven't gotten that....but he will eventually figure out that I am NOT going to let him in and start giving notice.
Problem is he wants in every other day...he is planning a lot of construction on the building...so if he sends me written notice that he wants in and I still refuse to let him what will happen? Is this just grounds for him to evict us? Or can he force me to let him in. I know eviction is BAD but I am not concerned about that I DO NOT WANT THIS GUY IN MY HOME ANYMORE! My concern is because he will own the propety can he call cops and have them force me to let him in or just evict us for not complying? If the only thing he can do is start an eviction then thats good but I want to know before I do anything...don't want to get in trouble.
Also since he obviously plans to start this massive construction on the property before we move out (yes we are looking for a place but haven't found one yet) Do I have any rights at all or do I just have to put up with the chaos...does this fall under peaceful enjoyment? and if so how can I make him stop the construction? I have children and dont want them getting hurt.
