I closed on a refinance 5/24/06 and paid money due at closing. May 30th, title company called saying an addendum needed to be signed and returned immediately. I authorized sending addendum by email which went into my jumK mail resulting in a one day delay of return but into the next month, 6/1/06. Every item in the addendum was listed in the original instructions to loan including interest through 6/1. The lender funded on 6/1 but the title company did not return addendum and did not inform me for 3-4 days. From this point and for two months, began emails trying to re-sign, re-draw, whatever it would take to complete the refinance. The Broker said it was the title company who needed to order re-draw; the title company said it was the broker; then title company said it was up to me to re-draw (6 weeks after the fact); the lender admitted they did not receive addendum nor did they know what the problem was since they funded on 6/1. The lender requested the money back on 6/20 considering it to be a non-funded loan. Who is at fault? Do I have a case against broker? title company? or lender for not following through? I'M IN TEXAS.
