:( ok here it is in black and white i was took up into the office becouse i questioned the way we were handed certin programs as one of my gm were explaining things to me very firmly a second gm jumped in an stated were else would i find a job that put up with my mental problems and mental issues well i didnt say any thing at the time i deside to look up on the web if she was wrong to say this to me let alone in front of five upermanagment gms,
i felt she dont me wrong and i stated it in front of some one else. the next morning i went in to work was not punched in and made a remark about a girl the hired back i said exaclty this why did they hire he back.the person that herd it ran upsairs and told on me then i got a call from my gm and said not to be taliking negative .and i said what nikki nark come running to you and tell on me i thought the whole thing was stuped. but then my neicce and fellow coworker said to call her so i did she ask what was going on so i told her. when we hung up / i got called up stairs and sent home for the day for negativity . so on my way out i told the two girls that get a ride with me they had to find a ride home and i left .now in the mean time both girls were cussing and totaly disrupting the floor never got in trouble. now today me and my neaice were called to the hospital in a emergency with the family since i didnt call in tell i got home i was told not to come in tell i called work in morning i have never been wrote up for missing work my neaice has . but she is nt in trouble and she still has not called in . why is this fair. if they punish me do they have to punish her to and if they do not do i have a right to get unemployment for being termanated.sorry for the spelling

It is very hard to follow you post. As I understand it, at somepoint someone made a comment about your mental health issues you felt shouldn't have been made. On a different day you made a comment to others about someone who was rehired and were sent home because someone told on you. On yet a different day, you and your niece who also works there missed work but didn't call in until the end of the day because of a family situation. You were fired but your niece has not been, even though she didn't call in yet.

Assuming this is the story, I don't see how any of them are related in any way. The comment about your health may have been insensitive (assuming you even have a health condition) but one comment with no adverse action does not constitute illegal discrimination.


I'm sorry but I'm just not seeing the connection between this one person's comment and being sent home for making an inappropriate remark about a rehire. Was the same person who made the comment the one who sent you home? Why do you feel they were connected?

As for not calling in until the end of your shift, most employer's would consider that a valid reason for termination. Do you and your niece have the same supervisor, position and tenure? There are not laws that require an employer to treat all employees the same. They just can not use a legally protected characteristic as the reason for treating two differently. If you neice hasn't called in, how do you know she won't be terminated when she does?

The long and short is that the only indication of discrimination you have shared is one insensitive comment about your health by someone it isn't clear has any influence over any of these other events. That isn't quite going to cut it to prove illegal discrimination.

you see they thought i was going to call th labor board or the eeoc,never said i was,they know my uncle is a lawer and i talked to him yes i have depression,but has never stoped me from going to work or been a problem for me.i have been there for over a year my neice has not been there as long ,ever since they heard i talked to my uncle this has been going on .every little thing i do i get in trouble for. yet there are worse things going on. like the total disrespect to management, by cusing them and walking out on them , i made one coment about hiring someone before i was on the clock then once i clocked in got introuble for it and they have been on my case ever since.

It seems you have had several instances of questioning management's decisions and presumably not in an appropriate way. Employees don't get called to a meeting with multiple GM's unless there's a real problem. And then you were absent without calling in, even though you certainly could have. (Hospitals do indeed have telephones.)

If they don't terminate your employment at present, then my advice to you is to return to work, just do your job and keep your criticisms of management to yourself.

Yes, you do have the right to free speech guaranteed under the Constitution. However, this right just means that the government will not prosecute you in any way for anything you say within certain guidelines.

It does NOT mean that you cannot be held responsible for saying something to your boss, about your boss or about a coworker. You can, and should, be held responsible for your words in a workplace and can be fired for them if they disrupt the workplace in the opinion of management.

It may or may not be unfair that they seem to be "picking" on you, but I'm not seeing evidence that it has anything to do with your disability. One insensitive comment in more than a year does not call into question problems that have been going on during your entire tenure.
