I was called into my manager's office on tuesday afternoon to receive information that i would be taking unpaid days off, because an asst manager had accused me of smoking pot. :eek: i offered to do drug testing immediately and was sent the next day. the asst manager ended up quiting, but before he did he told over 5 other employees this fabrication. my drug testing came up negative of course, but now employees are looking at me like i am a drug addict. i am thinking of sueing the asst manager. do you think i have a case? :confused:

If the manager had reason to "suspect" the use, then I don't think so. It seems that the ***. manager will pay for this by being unemployed and unable to recieve unemployment, since he/she quit instead of being fired. You can always have an initial consultation with a lawyer to see if it is worth pursuing. You may want to voice how your test was negative, and maybe even ask your manager to send out an email stating that you were found to be clean, if it would help from the ones who are looking at you wrong.

No, you don't have a case for defamation. Have yo utold the others it isn't true? I wold be surprised if they beleived this departed manager over you, especially once you have the drug test results. You haven't suffered any damages and this should blow over soon.
