Did you get a reciept with a date on it when you gave the late fee, not when she cashed the cashiers note? Without a reciept stating that fact, they can say that they recieved the payment anytime up until the day the cashiers check was cashed. They can choose not to renew your lease. I don't know at what point they have to tell you, or how long they have to give you sorry. I would start looking now for a place to live. I wish you the best of luck, sorry this is happening!

We haven't been required to pay a late fee since 5/12/03. Thing is, since we didn't get any official papers stating the fact, we continued to pay the late fee's on top of rent for the next, to be on the safe side, until we rec'd yet another verbal agreement that it was unnecessary on 4/7/04.

And that's the kicker. We did turn in rent on the 7th of April, but all we have in the way of proof is the date on our reciept off of our cashiers check and our word. The landlady didn't post it in the ledger as being recieved until 05/01/06 ...suspiciously, the same exact mess-up she had done the prior year, as we see on our complete tenant ledger.

Seriously, there ought to be stricter laws governing this sneaky underhanded crap that Landlords can pull. I just wish I knew who I could talk to about this, locally. Now, since I attend the Univ. full time, and work full-time to pay for it and all of our bills, we have nothing in the way of savings. My wife also supports her younger disabled sister who she shares joint custody of, and since that's a full time job in itself, her only income has been the $300/mo from sharing respite care. Not to mention helping to support an extra person has put us in the EVIL realm of CC debt. So having to move, on such short notice, will literally put us on the streets. :mad: :mad: :mad:
You may want to check to see, since you take care of a disabled person, if they have to do different things to evict you. This is why it is so important that you request a reciept for all monies given, so they can not pull this. So sorry! You may also want to see if there is a program that could help you with first last and deposit, since you are caring for someone who is disabled. They offer something similar in Oregon, if you are caring for a child or a disabled person.
