brenda_1968 08-25-2006, 09:10 PM My husband works for a company in alabama where the supervisor posts a note every month on a pole in their dept. saying " plan to work monday through sunday unless told otherwise." Their schedule is monday through thursday 10 hours a day. They do not tell them til thursday evening if they will have to work friday, saturday and sunday. Most of the time the supervisor is a smart butt and tells them to go look at the sheet that says "plan to work monday through sunday unless told otherwise." Is it legal for them not to have any notice at all to work overtime? Also that same supervisor made all the die setters sign that paper yesterday and told them they "have" to sign it and if they don't come in for any reason they will get 1 1/2 points. My husband has no problems working overtime as long as it's done the right way. His supervisor is ex army and treats the employees like he's their drill sergeant. He is mean and cusses them at times and treats them pretty bad. The way this man is doing things isn't right. These papers he's making these men sign aren't approved by personel, human resources and is not on company letterhead. I don't know if that makes a difference or not. I know the plant manager didn't like it at all when he saw those letters posted on a pole and not giving these men the proper notice to work the weekends. Is there anything you can tell me on this matter?

I cannot find anything on the Alabama Department of Labors site, that says that they can not do this. It appears that other than just making sure you are paid, and not even overtime pay, there are no labor or hour laws? If someone can find anything else to add, they will be by to say so. Sorry, it seems the state of Alabama doesn't do much for thier employed.
brenda_1968 08-25-2006, 10:24 PM it's really sad that other states have laws like you have to have 24-48 hours notice to work overtime and you can work 11 days straight but that 12th day you have to have it off. I worked in California and that's the way it was there. And you couldn't work more than 70 hours in a work week. There HAS to be something protecting my husband and his workmates. And my husband is a leadman and this is how he gets treated by his so called boss. Is there any law protecting him from getting yelled and cussed out by this supervisor and making it to where it's an unsafe environment to work in? My husband is a safety team leader and has had to write warning sitations on other employees for yelling and verbally fighting because it was a safety issue. Those people called attention to themselves and make the other employees not be cautious of what they are doing. They could lose a finger, arm or something from their machine could fall down on them and crush them.
I think if my husband and those other men that were forced to sign that paper would go to the HR manager then maybe they could get something resolved but they are all afraid of losing their job. Some people are vindictive.

I am afraid it is not illegal to yell or be immature, or just plain mean, I wish it was at times. What kind of work do they do? I am only aware of laws protecting someone like a pilot whos other lives are in thier hands, of working to long. I did know of a boys parents who sued mcdonalds because they overworked him and on the way home he fell asleep at the wheel, but still it is not law. It sounds like bad management, but not illegal. Is you husband in a union?
brenda_1968 08-25-2006, 11:13 PM He works in a place where they build the rails for car and truck seats to make them slide backwards and forwards. I didn't think it was a law for the supervisor to be an ***..lol but it's a safety issue. Like I said if they would all go to the HR dept then I know it would be looked into. The HR manager is very fair. I used to work there myself and after getting hurt there and then finally hiring my own doctor to find out what the problem was, that I have a muscle disease I never knew I had and the injury I sustained from this company made the disease really get nasty, well they let me go after 13 weeks because I could not return to work. They have a handbook and literally make up new rules as they go along that cancels out all the old ones that you signed off on when you were hired. It's crazy. They have no union there at all. They strictly forbid it. It is a German owned company and they are tough to work for. My husband doesn't mind working the overtime at all. It's just the way his supervisor is going about it. He will do whatever he needs to do for his employer. That is how he went from a temporary employee making only $7.50 an hour to more than doubling it in 2 1/2 years.
Funny thing is, the supervisor is making those men come in and work oh 6-7 days a week, 12 hours a day and on those weekends that everyone has to come in he's off with his family. It's made moral very low and people bitter.
Those other guys deserve to be off with their families too or at least be able to know when they have to work so they can plan something with their spouse and kids like the supervisors do. My husband is a leadman which is right below the supervisor and doesn't get those priviledges. But like I said before, they are all scared to go above his head cause he's a jerk. They think they will get fired because he's so mean and vindictive. I was always taught to go up the chain of command when you have a problem but some people take that as a personal insult or threat. One day maybe alabama will make some laws that protect people from employers like this one. Good honest people can't get protection but the crooked employers can. Doesn't seem right to me. I thank God I don't work there anymore. I'm not one to sit and let someone run over me like these men are. Thanks for your help in this matter. It's much appreciated.

I don't feel like I am helping you much with the bad news and all, but we are here for you, even if it is just to vent. If the ones who work there aren't willing to go to H.R, then there is little you can do. I would imagine since there are no laws backing these people, that I can find at least, they may very well be fired for not being a team player. I could see these people doing this to intimidate others from complaining. I may be very wrong on any of this and if I am someone will correct me.
There are no laws dictating how much, or any, notice of overtime be given, sorry. That is true in all 50 states. There is NO state where the law requires you be given 24-48 hours notice of overtime. There may have been a company policy or a union regulation, but no state has such a law.
