I've been accused of stealing form a retail job in NYC. The day the event occured the manager I took the shift over from had not closed out and counted all the days money and left as soon as I arrived with out telling me anything. The draw was short and I was suspended, but that was a week ago and I have not heard back from the greneral manager since.
Am I entitled to unemployment? How do I get compensated? :cool:
It will be up to the state to determine if you are eligible for unemployment. You begin by contacting them and applying for benefits.

Not based on what you've posted. It is not a wrongful termination when an employer discharges an employee on suspicion of wrongdoing, even if they are incorrect.
No. Wrongful termination does not mean you were fired for something you didn't do. It means that you were fired for a reason prohibited by law.
The employer is not prohibited from firing you for suspicion of theft, even if they are mistaken.

So will they have to prove that I stole to deny unemployment benefits? Or I'm just out.

If they choose to protest your claim for UI benefits, the burden of proof is on the employer to convince the state that they fired you for a reason which, under the state guidelines, would disqualify you for benefits. You have nothing to lose by filing, and I would recommend you do it immediately.
