View Full Version : Need advice on apartment damages to my property Texas

Hi all! I have had a recent bit of bad luck recently. I was hoping someone could give some guidance as to what my options are, if I even have any.
While we were gone on the weekend, the hot water pipe above my sons closet burst. It then flooded his entire room. Damaging the box spring of his bed as to where it is unusable. Most of his clothes were ruined. Things like toys, a sleeping bag, and other kids stuff was damaged with water and mold. An antique comic book set which was in mint condition lost.
So they come to fix it and plumbers are walking in and out of our apartment until 5 a.m. The plumber also stated that the pipe had previously burst at some point because there was a rusty old clamp over the leak. The clamp just finally gave out.
The apartment manager basically says to us "Too Bad for you". She offers to dry and shampoo the carpet. (This is the 2nd time the room has flooded - last time was due to the fridge leaking) My husband pushed back and said well this is the 2nd time, and we are worried about our allergies. She then says well I will replace the foam but not the carpet. Not to mention the fans which are blowing the carpet dry is on our electric bill also. She estimates this will last about 5 more days.
So do I have any rights here? Should the landlord be liable for certain damages done to my property? I am not out to rip anyone off. I would just really like for my son to have a bed and perhaps a few things replaced. Thank you in advance for any insight.

I am a landlord in Ohio and I REQUIRE my tenants to carry renters insurance and have me named as additional issured. This would cover your damages. As far as the landlord, in Ohio, they would be required to cover your living residence, i.e. the carpet and the walls repaired along with the pipe. They would not be required to cover your personal property. You might want to check how your lease reads in regards to your property.
